Terms of Service

Rules for using KogniFeed’s website, admin workspace, participant experiences, and integrations API.

1. Agreement

By accessing or using KogniFeed, you agree to these Terms. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

KogniFeed provides tools to design and publish insight interviews, collect participant responses, analyze sessions, manage CRM contacts, and integrate via API keys. Features and limits depend on your plan.

3. Accounts & security

  • You must provide accurate registration information and keep credentials secure.
  • You are responsible for activity under your account and for API keys you create.
  • Notify us promptly at hello@kognifeed.com if you suspect unauthorized access.

4. Acceptable use

  • Do not use the service for unlawful, harmful, deceptive, or discriminatory purposes.
  • Do not attempt to bypass security, rate limits, or access other workspaces’ data.
  • Do not upload malware or content that infringes third-party rights.
  • Obtain appropriate consent and provide required notices when collecting participant data.
  • Comply with applicable privacy, employment, and research regulations in your jurisdiction.

5. Customer content & data protection roles

You retain ownership of content you submit (interview configs, CRM data, participant responses). You grant us a limited license to host, process, and display that content solely to operate and improve the service, including AI-assisted features you enable.

For participant and CRM contact personal data processed through your workspace, you act as the data controller (or equivalent under applicable law) and KogniFeed acts as a data processor. You are solely responsible for: (a) determining lawful grounds for processing; (b) providing required privacy notices and clarification texts to participants and contacts; (c) obtaining valid consent or another valid legal basis where required; and (d) ensuring that data you collect via KogniFeed and transfer to third-party CRM, marketing, or other systems is handled in compliance with KVKK, GDPR, and other laws that apply to you.

Personal data collected on KogniFeed and transferred to third-party CRM systems or other integrations at your direction is processed on your instructions. KogniFeed is not responsible for your choice of recipients, fields mapped, or the compliance of external systems you connect.

6. API, CRM invitations & third-party integrations

API access requires a valid KogniFeed API key and is subject to documented rate limits and plan quotas. Keys must be kept confidential and must not be resold. We may modify endpoints with reasonable notice where practicable.

  • CRM features include contact storage, groups, personalized invite links (?c=), optional invite emails sent through KogniFeed, and API endpoints to upsert contacts and create or query invite links.
  • You are responsible for the accuracy of CRM data you upload or sync, recipient lists you email, and any automated flows you build against our API.
  • If you integrate KogniFeed with external systems (HubSpot, Salesforce, custom CRM, event buses, etc.), you are responsible for credentials in your stack, mapping decisions, and lawful transfer of data — including cross-border transfers when those systems store data abroad.
  • Do not use the API or CRM tools to spam, harass, or contact individuals without a proper legal basis.

A separate Data Processing Agreement (DPA) may be available on request for business customers who require contractual processor terms under GDPR or KVKK. Until a DPA is signed, these Terms and our Privacy Policy describe our processing relationship.

7. Plans, billing & trials

Paid plans, usage limits, and billing terms are described on our pricing page and in your workspace. Fees are non-refundable except where required by law or explicitly stated. We may change prices with advance notice.

8. Availability & changes

We strive for reliable service but do not guarantee uninterrupted availability. We may modify or discontinue features; material changes to paid functionality will be communicated when reasonable.

9. Disclaimers

The service is provided “as is” to the maximum extent permitted by law. AI-generated outputs may be inaccurate; you are responsible for reviewing insights before business decisions.

10. Limitation of liability

To the maximum extent permitted by law, KogniFeed is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. This includes damages arising from your integration with third-party CRM or other systems, unauthorized use of API keys or credentials under your control, or processing you direct us to perform on participant or contact data.

Our aggregate liability for claims relating to the service is limited to the fees you paid us in the twelve months before the claim (or EUR 100 if you use a free plan). Nothing in these Terms limits liability that cannot be limited under mandatory law.

11. Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or risk to the platform. Upon termination, your right to use the service ends; certain provisions survive.

12. Governing law

These Terms are governed by the laws of Türkiye, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise.
